CJI Statement on Collegium System: Chief Justice of India DY Chandrachud defended the collegium system. Regarding the collegium system, he said on Saturday (March 18) that no system is the best, but what we have developed is good. He said that the collegium system was designed because the independence of the judiciary is a core value and for the judiciary to remain independent, external influences have to be avoided.
With this, CJI Chandrachud said in the India Today Conclave that merit is the main parameter in the collegium system, which considers inclusion of gender, marginalized communities and m inorities for wider representation in regional and high courts along with seniority. He said that the process of judicial appointments should be transparent, so that people would have more faith in the work of the judiciary.
Said this on the long holidays of the Supreme Court
Chief Justice of India Chandrachud said on the long summer and winter vacations given to the judges of the Supreme Court that the judges of the Supreme Court work for 200 days (about 6 and a half months) in a year. Which is 80 days in the Supreme Court of America. The Supreme Court of Australia also has less than 100 days. The Supreme Court of Britain and Singapore work for 145 days.
CJI told- how the collegium works
CJI DY Chandrachud said that we first look at the qualification to assess the professional competence of the judge. The second criterion is seniority, because doing justice is service. It also takes care of the spirit of inclusiveness, for which we give equal opportunities to bring gender, marginalized communities – SC/ST and minorities into the Judiciary, but all this without compromising on merit. Regarding the last criterion, the CJI said that while making appointments to the Supreme Court, we decide that efforts should be made to give adequate representation to the High Courts of different states and regions.
