Review Petition on SC Verdict on Demonetisation: A review petition was filed in the top court on Sunday (February 5) to review the Supreme Court’s decision on note ban. In 2016, the Modi government had taken the decision of demonetisation in the country. After which the old notes of 1000 and 500 rupees went out of circulation. Opposition parties have been besieging the BJP-led central government since the beginning on the decision of demonetisation.
Last month (January 2) the Supreme Court had given an important decision regarding demonetisation. A five-judge constitution bench of the top court had delivered the verdict that day with a majority of 4:1. The majority verdict of the top court said that the government’s process of demonetising Rs 1,000 and Rs 500 notes was not flawed, nor was the decision taken in haste.
Who is the petitioner?
According to the news agency PTI, the review petition has been filed by a lawyer ML Sharma. Sharma is one of the 58 petitioners who challenged the government’s decision in the Supreme Court after demonetisation was announced on 8 November 2016.
Filing a review petition on Sunday, Sharma argued that the constitution bench did not consider his written arguments while giving judgment on various petitions, due to which proper justice could not be done. Petitioner Sharma said that therefore has requested for review of the apex court’s decision related to demonetisation.
What was the verdict given by the constitution bench in January?
A five-judge constitution bench headed by Justice SA Nazeer had said that there should be great restraint in matters of economic policy and the court would not interfere with any such opinion of the government if it is based on relevant facts and circumstances or on the advice of experts. Are. Justice BV Nagaratna, however, gave a dissenting judgment and said that the demonetisation of Rs 500 and Rs 1,000 notes was illegal.
