The Supreme Court’s big decision came amid the ongoing debate over the sedition law, which has always been in controversy. In which the Supreme Court banned the use of this law. Also while ordering that, till the sedition is not reconsidered, no case will be registered under it. During the hearing, an affidavit was filed in the Supreme Court on behalf of the Central Government saying that there is no need to change the sedition law. Just before the hearing of this matter in the Supreme Court, the second affidavit was filed by the Central Government, in which the government said that it is ready to reconsider and investigate the sedition law. Along with this, the court was told that till the investig ation is done, the court should not take it up.

  5. Despite the Centre’s affidavit, the Supreme Court took a tough stand and clearly said that changes in the sedition law are necessary. The Supreme Court said that all pending cases, appeals and proceedings related to the charge of sedition should be kept adjourned. The relief given to the accused will continue.
  6. Whereas with respect to pending cases of sedition, the central government suggested to the Supreme Court that bail petitions be heard expeditiously. Now the petitions challenging the validity of the provision of the law will be heard in July.
  7. In its order, the Supreme Court said, “We expect that till the said provision of the law is reconsidered, the Center and the states will be able to file fresh FIRs, conduct any inquiry under section 124A of the Indian Penal Code.” or to take any punitive action.

Regarding this decision, the Congress said that the country’s top court has given a message that showing a mirror to power cannot be sedition. The party also said that the order of the Supreme Court has also proved that the promise made by the Congress to abolish the sedition law in the 2019 Lok Sabha elections was the right way.

CPI(M) general secretary Sitaram Yechury said in the press briefing that “CPI(M) has always opposed the sedition law and called it a faulty law brought by the British to suppress our freedom fighters.” It has no place in the law books in independent India. The good thing is that the court has ordered that this provision will be stayed.

Union Law Minister Kiren Rijiju spoke of ‘Lakshman Rekha’ for all institutions including executive and judiciary and said that no one should cross it. “We respect each other,” he said. The court should respect the government, the legislature. Similarly, the government should also respect the court.
  13. Union Minister Rijiju also responded to Rahul Gandhi’s tweet. “If there is one party which is opposed to freedom, democracy and respect for institutions, it is Congress. This party has always stood with the forces that broke India and left no chance to divide India. The UPA government has the worst track record of registering sedition cases.
